Article 1. Context
The Pigments group builds strong and lasting relationships with its users, ensuring the security and confidentiality of its users’ personal data. Pigments complies with all French and European regulations and legislation concerning the protection of personal data. Pigments is committed to an ongoing approach to protecting its users’ data, in compliance with the French Data Protection Act of January 6, 1978 as amended (hereinafter “LIL”) and the General Data Protection Regulation (EU) of April 27, 2016 (hereinafter “GDPR”).
Article 2. Scope of application
This privacy policy describes how the different entities of the Pigments Group use your personal data.
Article 3. Collection of your personal data
We inform you that in the context of the use of our Products and Services, your data may be collected through the data you communicate to us. The said information will then be treated by Pigments as personal data within the meaning of the RGPD.
Article 4. Use of your personal data
We use the personal data collected by the Service in particular but not exclusively for the various purposes described below:
• To help you participate in our Products and Services;
• To provide you with technical support;
• To contact you by post, SMS/MMS and/or any other means of communication in order to provide you with information to help you make better use of our Products or Services.
• To analyze your data, enabling us to improve our Products or Services, identify your usage patterns and determine the effectiveness of our Products or Services;
• To prevent and detect threats to the security of our Products or Services, fraud or other unlawful activity.
• To comply with our legal obligations, settle disputes and enforce our contracts. Pigments is committed in accordance with the RGPD to respecting standards of transparency in the collection, confidentiality and security of your personal data.
Article 5. Recipients of your personal data
We will never pass on your personal data to third parties without your prior express consent, except in the cases listed below:
• Pigments may communicate your personal data to persons in charge of marketing, sales, customer relations, administration, logistics and IT;
• Pigments may communicate your personal data to third-party companies for the purposes of the proper operation of its sites and applications and of the Services and Products;
• Pigments may communicate your personal data to partner companies of Pigments provided that you have given your consent when subscribing to the sites or applications of the Pigments Group,
• Pigments may communicate your personal data to public authorities, if permitted by law, or in the context of legal proceedings.
In such cases, your personal data will be communicated in compliance with the provisions of the LIL and the RGPD, ensuring compliance with this policy and the confidentiality of your personal data.
Article 6. Retention period for personal data
We keep your personal data only for as long as is necessary for the purposes for which it is to be used, in accordance with legal requirements. Article 7. Users’ rights Whenever Pigments processes personal data, Pigments takes all reasonable steps to ensure that such data is accurate and relevant to the purposes for which Pigments processes it. In accordance with current European regulations, users have the following rights: – right of access (Article 15 RGPD) and rectification (Article 16 RGPD), updating, completeness of users’ data – right to block or delete users’ personal data (Article 17 RGPD), when they are inaccurate, incomplete, equivocal, outdated, or whose collection, use, communication or storage is prohibited – the right to withdraw consent at any time (Article 13-2c RGPD) – the right to limit the processing of user data (Article 18 RGPD) – the right to object to the processing of user data (Article 21 RGPD) – the right to portability of data provided by users, where such data is subject to automated processing based on their consent or on a contract (Article 20 RGPD). Article 8. Cookies and Internet tags
6.1 Cookies
A “cookie” is a small information file sent to the user’s browser and stored within the user’s terminal (e.g. computer, smartphone), (hereinafter “cookies”). This file includes information such as the user’s domain name, the user’s Internet service provider, the user’s operating system, and the date and time of access. Cookies are in no way likely to damage the user’s terminal. Pigments is likely to process information about the user’s visit to the Site, such as pages consulted and searches carried out. This information enables Pigments to improve the content of the Site and the user’s browsing experience. As cookies facilitate browsing and/or the supply of Products and Services offered by the Site, the user may configure his/her browser to allow him/her to decide whether or not to accept them, so that cookies are stored in the terminal or, on the contrary, are rejected, either systematically or according to their sender. The user may also configure his browser software so that acceptance or rejection of cookies is proposed from time to time, before a cookie is likely to be recorded in his terminal. Pigments informs the user that, in this case, it is possible that not all the functions of his/her browser software will be available. If the user refuses the storage of cookies in his terminal or browser, or if the user deletes those stored there, the user is informed that his navigation and experience on the Site may be limited. This may also be the case when Pigments or one of its service providers cannot recognize, for technical compatibility purposes, the type of browser used by the terminal, the language and display settings or the country from which the terminal appears to be connected to the Internet. Where applicable, Pigments declines all responsibility for the consequences linked to the degraded operation of the Site and any services offered by Pigments, resulting from (i) the refusal of cookies by the user (ii) the impossibility for Pigments to save or consult the cookies necessary for their operation due to the user’s choice. To manage cookies and user choices, the configuration of each browser is different. This is described in the browser’s help menu, which will indicate how the user can modify his or her wishes with regard to cookies. At any time, the user may choose to express and modify his or her wishes with regard to cookies. Pigments may also use the services of external service providers to help it collect and process the information described in this section. Finally, by clicking on the icons dedicated to the social networks Twitter, Facebook, Linkedin appearing on one of Pigments’ websites and mobile sites, and if the user has accepted the deposit of cookies by continuing to navigate on one of With Up Com’s websites, Twitter, Facebook, Linkedin may also deposit cookies on your terminals (computer, tablet, cell phone). These types of cookies are deposited on your terminals only if you consent to them, by continuing your browsing on the Pigments Website or mobile application. However, you may withdraw your consent for Pigments to deposit this type of cookie at any time via our Cookie Management Charter. 6.2. Internet tags
Pigments may occasionally employ Internet tags (also known as “tags”, action tags, single-pixel GIFs, clear GIFs, invisible GIFs and one-to-one GIFs) and deploy them through a web analytics partner that may be located (and therefore store related information, including the user’s IP address) in a foreign country. These tags are placed on the various pages of the site visited. This technology enables Pigments to evaluate visitors’ responses to the Site and the effectiveness of its actions (for example, the number of times a page is opened and the information consulted), as well as the user’s use of the Site. The external service provider may collect information about visitors to the Site and other Internet sites using these tags, compile reports on Site activity for Pigments, and provide other services relating to the use of the Site and the Internet.
Article 7. Social networks
Users can click on the Instagram and Linkedin social network icons on the Site. Social networks enhance the user-friendliness of the Site and help to promote it through sharing. Video sharing services enrich the Site with video content and increase its visibility. When the user clicks on these buttons, Pigments may have access to personal information that the user has indicated as public and accessible from his/her Instagram and Linkedin profiles. However, Pigments does not create or use any database independent of Instagram or Linkedin from the personal information that the user may publish there, and Pigments will not process any data relating to the user’s private life in this way. If the user does not wish Pigments to have access to the personal information published on the public space of his/her profiles or social accounts, he/she must then use the means made available by Instagram and Linkedin in order to limit access to his/her data. Article 10. Security of personal data.
The security of your personal data is of major importance to Pigments. We are therefore committed to implementing a sufficient level of protection. With this in mind, we have implemented measures to preserve the confidentiality, protection and integrity of your personal data. Despite our commitment to the security of your personal data, no security system can prevent potential security breaches, particularly due to the characteristics and limitations of the Internet.
Article 8. Transfer
Pigments will ensure that the transfer of any personal data is carried out in compliance with the applicable laws and regulations on the subject, and in particular in compliance with the provisions of the LIL and the RGPD.
Article 9. Modification of the privacy policy
Pigments may make changes to this privacy policy. If we make any material changes to this Privacy Policy and the way we use your personal data, we will post such changes on this page and we will endeavour to notify you of any material changes.
